The administrator of personal data of users of Merkandi platform who are individuals is Merkandi LTD (Unit 4E, Enterprise Court S63 5DB Rotherham, United Kingdom), which means that it determines the purposes and methods of processing your personal data.

The purpose of the Policy is to determine the actions taken by Merkandi for the protection of your personal data, processed through the platform and mobile application, as well as within the related services. Policy sets out, in particular, the scope and legal basis for the processing of your personal data, which are collected by Merkandi in connection with the use of the platform and mobile application by you.

We receive your personal data from you when you set up your account, in connection with activities you carry out on the platform, posting or viewing offers and in connection with updates to your personal data made through your account. The processing of personal data may also be related to the performance of a number of other activities directly related to the use of the platform and the mobile application. The use of the platform, including the downloading of the mobile application or the use of the mobile application or related services, is only possible after you have read the provisions of this Policy and the Terms and Conditions.

Scope of personal data processing

The scope of personal data processed by Merkandi may vary depending on what services or functionality provided by Merkandi you use:

Registration

During the registration process, we require the following personal data: e-mail address, login, password, phone number and information about the company (enterprise) and its address. Failure to provide the above data means that we can not enter into a contract with you, and consequently will not be able to use Merkandi services.

Use of the account 

After registering, we will require you to fill in your identification details and provide information on your address and contact details necessary to make contact. In order to be able to fully use the platform, we require you to provide your age so that we can verify your legal capacity. If you provide us with an account for withdrawals, we will process the declared personal data related to this account, i.e. your name, bank account number and home address.

For full account activation, we will require you to submit the relevant documents for verification. This will enable us to confirm the data you provided during the account creation process. We will process the personal data contained in the verification documents for the purposes of the platform.

After registering an account and during the use of Merkandi services we commit you to constantly update any personal data given, if in any respect there are changes.

In addition, we collect information about your activities on the platform, including purchase history, listings, payment methods selected and the content of comments and messages sent.

When using your account, you may also provide us with other, optional personal data, e.g. by uploading your photo or a graphic of yourself (avatar), thereby consenting to its processing. The provision of such personal data is entirely voluntary.

In addition, we may obtain your personal data in connection with the use by you of the option to log on to the platform or mobile application through external authentication services offered by other entities operating independently of Markandi.pl (e.g. services offered by Google, Apple or services offered within the services, including those of a social nature - such as Facebook). In this case, we will only acquire your personal data in the form of your name or username, your e-mail address and an avatar published on such service or site and we may associate this personal data with your account or process it only for the purposes of such login or registration to the platform. When using external authentication services, you should read the terms and conditions and privacy policies of the providers of such services.

Execution of transactions

Making payments is associated with the need to process other personal data, i.e. data contained in the offer (including, in particular, the content of the offer), transaction data (in particular, bank account number, payment method, the address of receipt of goods, method of delivery), data to the VAT invoice and data allowing the tracking of shipments, sending messages, communicating with other users and making payments for services provided by Merkandi. Merkandi may also have access to the content of messages sent between users in the framework of discussions and disputes. In order to handle the transaction, we may use your personal data, which were given to us during the registration. In addition, to handle the sale we may also process your personal data, including, inter alia, turnover value, information about orders (their implementation or cancellation, shipping numbers).

Contact form

In the contact form, we process contact data that is necessary for us to communicate with you and to fulfil your request. This may include personal data such as your name, email address or telephone number.

In addition, as part of user support, we can also contact you through the use of personal data placed for this purpose in the account or provided by you through social media channels (eg Facebook Messenger, Instagram, Twitter, WhatsApp, WeChat). In the case of contact with Merkandi through social media channels offered by entities independent of us, Merkandi acquires personal data in the form of user name (in the case of e.g. Facebook Messenger, Instagram, Twitter) or phone number (e.g. in the case of WhatsApp, WeChat) only for the purpose of contact. If permitted under applicable law, Merkandi will also be entitled to obtain and store other personal data relating to the communication carried out, such as information about support requests or feedback from Users.

Incoming calls to helplines

Incoming calls to Merkandi hotlines are recorded. If you decide to contact us by phone, your personal data, like for example, telephone number and the content of the recording (including information provided during the conversation), we will process in order to implement the application.

Participation in loyalty programmes, competitions or promotional actions

In connection with participation in loyalty programmes, competitions or promotional campaigns, we will process your personal data that is necessary for the above events. Depending on the type of event organised, this may include your name, contact details (such as telephone number or email address) or any other data necessary to meet the criteria for participating in these events.

Marketing activities 

As part of our marketing activities, we may, either on the basis of legitimate interest or on the basis of your consent, process information to help us tailor advertising and content to your preferences and expectations (including in relation to the display of behavioral advertising). In this regard, Merkandi uses, among others, technology based on digital fingerprinting, which consists of collecting the so-called digital "fingerprints" of the user's device, which allows us to identify the device from which you use or application that you install. The information we collect about you in this regard may constitute personal data. We may process personal data such as, but not limited to, your IP address, data derived from cookies, the parameters of the software and hardware you use, the configuration of your device (e.g., data on installed plug-ins), or information about your website traffic (including the use of network communication protocols), pages viewed, and information on the use of the mobile application.

Action in connection with the assertion or defence of claims

We may process your personal data in connection with the right to assert or defend against claims. For this purpose, Merkandi processes your personal data throughout the period in which the claims arising from the contract concluded by the State with Merkandi or related to the use of services provided by Merkandi, platforms, mobile application have not become time-barred under applicable law. This may be, for example, the amount of debt, information related to a particular order or offer, transaction data, or information obtained in connection with the establishment of contact by Merkandi infolinks. The scope of personal data processed by us may vary from time to time, depending on the subject matter of the claim.

Aims, grounds and duration of processing of personal data

Depending on what services provided by Merkandi you use, different are the purposes and legal basis for the processing of personal data by Merkandi and the periods for which Merkandi may store or use your personal data.

For each of the purposes of processing we have specified the legal basis and the maximum period for which personal data will be stored. After the indicated period we will not use your personal data for the indicated purpose. However, this does not mean that we will delete it in every case. We will store your personal data for the longest of the indicated periods relating to the specific services of Merkandi. Account registration and maintenance, user transaction processing

The use of some of the functionalities available on the Platform (including the use of the mobile application) requires you to register in accordance with the Regulations. Establishment and use of the account is related to the processing of your personal data by us.

Merkandi also processes your personal data in connection with the handling of transactions.

The information posted by you on the platform does not come from Merkandi and are not initiated by Merkandi. For this reason, to the fullest extent permissible under the law applicable, Merkandi is not responsible for the information provided. In offers and messages as far as possible should not give personal information. By placing your personal data in the offers or messages, you do it on the basis of your own, considered and informed decision. You should therefore carefully consider the risks involved in providing such information. 

In connection with the processing of your account and your transactions, we process your personal data as described in the table below. In addition, your personal data may be processed for other purposes, including analytical, marketing and ensuring the security of the services provided, which you can learn more about in this Policy.

User support and contact form

If you contact the customer service, including by making a phone call to the hotline, Merkandi in the conduct of the Platform may process (eg, store or analyze) your personal data.

Merkandi may also collect your personal data if you make contact using the tools available in Merkandi, including the contact form available in Merkandi. These personal data are necessary to enable Merkandi to contact you, as well as to enable you to contact other users, for purposes directly related to the functioning of Merkandi. Provided by Merkandi contact form is not used to conduct private correspondence unrelated to the transaction and use it for such purposes may constitute an infringement of the Rules. To prevent violations of law, including unfair practices, Merkandi collects data on communications made through the above-mentioned form. Merkandi may also analyze and block using special software content sent between the users through the above-mentioned contact form, in particular, if they are in the nature of spam (unsolicited advertising information), contain prohibited content such as an incentive to commit crimes or otherwise threaten the security of users, such as are intended to illegally obtain passwords to the account or violate the Rules.

In connection with the handling of queries directed to Merkandi. including through the contact form, we process your personal data in accordance with the principles described in the table below. Contact details of users who voluntarily take part in events, are processed by Merkandi in accordance with the law and for purposes related to these events. Within the Platform Users can also join the loyalty programs.

Merkandi may also use your personal data to conduct marketing activities. Such activities may consist of:

  • display on the Platform or mobile application marketing content that is not tailored to your preferences (contextual advertising). If the display of contextual advertising is using personal data, their processing is then carried out in connection with the implementation of the legitimate interests of the controller or a third party to promote their own activities or the activities of third parties Merkandi;
  • display marketing content that is tailored to your preferences, including the adaptation of categories of offers or individual offers in the settings of the Platform or the settings of the services of external entities on the basis of your activity on the Platform (behavioral advertising). Ensuring the security of the services provided

When it is necessary to ensure the security of services, including IT resources or the safety of other users, Merkandi is entitled to automatically obtain and record your personal data transmitted to the server by web browsers or your device when using the Platform or mobile application.

In order to ensure an adequate level of security Merkandi collects and records personal data transmitted to the server by web browsers or your device (which include, in particular: the technical elements of the device, your browser settings and details of your behavior on Merkandi), in a manner that creates a unique digital "fingerprint" of the devices or instances of applications that you use. Merkandi may use such digital "fingerprint" for additional authentication of the user. These actions help prevent fraud and abuse.

In order to ensure the security of the services provided, we process your personal data according to the principles described in the table below.

Merkandi may collect in the conduct of the Platform your personal data through technologies such as cookies, tracking pixels and objects shared locally (eg in the browser or on your device). 

Merkandi locally will collect information about the current location of your device in case you provide us with such personal data. This personal data will not be stored by Merkandi. Before downloading the location information you will be asked to agree to this.

Users' rights in relation to the processing of personal data and their exercise

Merkandi enables you to fulfil all your rights under the GDPR, i.e. the rights described in Articles 15-21 GDPR. Below we have included a detailed description of each right.

  • right of access to personal Data allows you to obtain from Merkandi information about the processing of your personal data by Merkandi, including primarily the objectives and legal basis for processing, the scope of data held, the entities to which your data are disclosed and the planned date of deletion of data.
  • the right to obtain a copy of personal data You can use to obtain a copy of your personal data that are processed by Merkandi.
  • the right to rectify your personal data You may take advantage if you notice that your personal data are incorrect or incomplete. In this case, we undertake to rectify any inconsistencies or errors in the personal data processed and to complete them if they are incomplete.
  • the right to remove your personal data You can benefit if: Your personal data will no longer be necessary for the purposes for which they were collected or otherwise processed by Merkandi; you withdraw your consent to the processing of personal data or object to the processing of your personal data and there is no other legal basis for the processing; your personal data will be processed unlawfully.

Recipients of personal data

  • Merkandi may provide your personal data to the following third parties:
  • entities cooperating with Merkandi running websites or providing web applications (including mobile applications), in order to publish user offers issued in categories of an advertising nature;
  • entities working with Merkandi , running websites or providing web applications (including mobile applications) to compare opinions on transactions, in order to collect opinions on transactions carried out on the Platforms, through surveys.

Merkandi may cooperate with third parties such as specialized providers of personal data storage services, analytical services, debt collection services, in order to provide services by these entities for the Merkandi. In this case, these entities are not authorized to use your personal data for their own purposes (personal data will always be processed on behalf of and for the purposes of Merkandi), and their actions are subject to applicable law and this Privacy Policy.

The scope of cooperation includes:

  • storage and access to information: storing information or accessing information that is already stored on your device, such as advertising identifiers, device identifiers, cookies and similar technologies;
  • personalisation: the collection and processing of information to personalise advertising and/or content on websites or apps;
  • ad selection, delivery and reporting: collecting information and combining it with previously collected information to select and deliver ads for you and to measure their effectiveness (what ads were shown, how often, when and where they were shown, and whether you took any action related to the ad, including, for example, clicking on the ad or making a purchase);
  • conducting debt recovery proceedings;
  • providing services to support / improve the implementation of orders placed on Merkandi.

Your personal data in the image (avatar) we share with other users in the case of communication conducted under the Merkandi.

Merkandi may share your personal data to public authorities under the law in connection with the ongoing proceedings for possible violations of law or to combat other possible violations of the Rules (including in connection with the proceedings relating to fraud and abuse of Merkandi).

Under the adopted policy Merkandi undertakes not to sell personal data of users. In the case of restructuring or sale of the business or part thereof and the transfer of all or a significant part of its assets to a new owner, personal data of users, including yours, may be transferred to the new owner in order to ensure the continuation of the provision of services under the Platform.

If you conduct sales under the Account, you are obliged, after obtaining from Merkandi personal data of other users who are natural persons, to comply with all obligations arising from the GDPR, including the obligation to provide information and provide them with the implementation of their rights under the GDPR.

  • Google Ireland Limited with its registered office in Dublin, Ireland, in connection with the use of Personal Data processing services offered by this entity, to ensure the provision of services by Merkandi offered under Merkandi;
  • Facebook - Facebook Ireland Limited with headquarters in Dublin, Ireland, in connection with the processing of data about pages viewed, content accessed;
  • UserEngage - UserEngage Sp. z o.o. with its registered office in Warsaw, Poland, in connection with the processing of browsing data, behavioural data, information about users and visitors, e-mail communication and direct marketing system;
  • Smartlook - Smartlook.com s.r.o. based in Brno, Czech Republic, in connection with the recording and processing of user behaviour, including behavioural data;
  • LiveChat - LiveChat Software S.A. based in Wrocław, Poland, in connection with the processing of browsing data, information about users and visitors, e-mail communication, chat;
  • Zendesk INC, based in San Francisco, USA, in connection with the processing of browsing data, information about users and contacting visitors, e-mail communication, chat;
  • Retool INC, based in San Francisco, USA, in connection with the processing of user data in the form of compilations;
  • Payment gateways - MultisafePay, iYzico, Przelewy24, Paypal, Stripe, in connection with processing payments and user information.

Merkandi always acts on the basis of mechanisms to ensure an adequate level of protection, for example, by using standard contractual clauses for the transfer of personal data to processors established in third countries, approved by the European Commission. 

Modification of arrangements

If necessary, Merkandi may change the provisions of this Privacy Policy.
